Website Terms of Use: User Overview

> Important: These Terms incorporate a separate Privacy Policy, but that policy is not included here. Therefore, the document does not provide a complete account of the company’s data practices.

1. Data Collection & Usage

The Terms indicate that Amplify may collect or receive:

• Account information: Registration details, username, password, and updated account information.
• Purchase information: Credit/debit card number, expiration date, billing address, shipping address, and transaction details.
• User-submitted content: Anything you post, upload, transmit, email, or otherwise provide through the Site, including support-chat content, feedback, images, and videos.
• Employment information: Names, contact details, resumes, and other information submitted for job opportunities.
• Information handled through third parties: Payment processors, e-commerce providers, linked websites, and other service providers may collect information under their own policies.

The Terms state that information is used for purposes such as:

• Creating and administering accounts;
• Processing purchases, payments, shipping, returns, and verification;
• Providing Site Services and support;
• Hiring and employment-related business purposes;
• Operating, promoting, marketing, and improving Company services.

The detailed categories of information collected, tracking technologies, retention practices, and disclosure practices are delegated to the separate Privacy Policy. Different Amplify products or services may have different privacy policies.

2. User Rights

The Terms expressly provide that:

• You retain ownership of User Content that you own.
• You may terminate your account by contacting the company.
• Certain jurisdictions may give you additional statutory rights, including return or cancellation rights.
• You may bring qualifying disputes in small claims court.
• You may contact government agencies about complaints or legal issues where permitted by law.

However, the Terms do not expressly describe rights to access, correct, delete, export, restrict, or opt out of processing of personal data. Those rights, if available, must be determined from the separate Privacy Policy and applicable law.

3. Third-Party Sharing

The company may share information:

• With third-party suppliers and service providers to process transactions, payments, shipping, and related orders;
• With affiliates for legitimate business or employment purposes;
• Through distribution or syndication of User Content to third-party services;
• When required or permitted by law or for law-enforcement purposes.

Third-party websites, applications, advertisements, payment services, and other linked services operate under their own privacy practices. Amplify disclaims responsibility for their content, security, and data handling.

4. AI/ML Training

The Terms do not state whether personal data, User Content, support chats, or Feedback is used to train artificial-intelligence or machine-learning models.

A significant concern is the broad license granted over User Content. It is perpetual, worldwide, transferable, sublicensable, royalty-free, and allows Amplify to modify, create derivative works from, publicly display, reproduce, distribute, and use the content for commercial, promotional, or other purposes. The license may extend beyond operating the Site and does not require notice, payment, or attribution. This language could potentially permit AI-related uses, but it does not expressly confirm AI training.

Feedback receives an even broader, exclusive, perpetual, irrevocable, sublicensable license and is expressly non-confidential.

5. Key User Obligations and Restrictions

Users must:

• Be legally able to enter the agreement;
• Provide accurate registration information and protect account credentials;
• Notify Amplify of suspected unauthorized access;
• Own or have permission to submit User Content;
• Obtain consent before posting another person’s image or video;
• Follow applicable laws, export controls, and product safety warnings.

Users may not:

• Use the Site for unauthorized commercial purposes;
• Scrape, data-mine, use bots, or collect usernames, passwords, email addresses, or other data;
• Upload unlawful, abusive, discriminatory, defamatory, harmful, or sexually explicit content;
• Hack, disrupt, reverse engineer, bypass security, or introduce malware;
• Send unsolicited bulk communications;
• Resell products or use products unlawfully.

A particularly notable provision imposes $50 per actual or intended recipient for unsolicited bulk communications.

6. Liability and Disputes

• The Site, User Content, third-party services, and products are provided “as is” and “as available.”
• Amplify disclaims implied warranties, including merchantability, fitness for purpose, non-infringement, accuracy, security, and uninterrupted availability.
• Amplify generally excludes liability for indirect, consequential, punitive, special, incidental, and lost-profit damages.
• Total liability is capped at the amount you paid Amplify for the relevant Site Products.
• Users must indemnify Amplify and related parties for claims arising from their use, breach, legal violations, or User Content.
• New York law governs.
• Most disputes must be resolved through individual, binding AAA arbitration, not court. Jury trials, class actions, and class arbitrations are waived. Small claims cases are excluded.

Some statutory rights may override these limitations depending on the user’s jurisdiction.

7. Changes and Termination

Amplify may change the Terms at any time by posting a revised version or using another reasonable method. The “Last Updated” date identifies revisions. Continued Site use after changes constitutes acceptance. Changes do not apply to disputes arising before the revision was posted or communicated.

Amplify may suspend or terminate accounts or access at any time, with or without notice or explanation, and may delete associated files and information without liability.
