Privacy Policy Overview

1. Data Collection and Use
AWeber distinguishes among:
- Customers: Account holders using AWeber’s services.
- Subscribers: Individuals on a Customer’s email list. The Customer generally controls their data; AWeber processes it on the Customer’s instructions.
- Advocates: Participants in AWeber’s referral program.
- Visitors: Website users.
Information collected
Depending on your relationship with AWeber, the company may collect:
- Account and contact information: Name, email, address, phone and fax numbers.
- Payment information: Credit-card details for Customers; tax IDs, Social Security numbers and related information for Advocates.
- Subscriber data: Information Customers collect through forms, integrations, in-person signups or other consent methods.
- Integration data: Information supplied by connected third-party services.
- Technical and usage data: IP address, geographic information, device identifiers, browser and operating system, access times, browsing activity, clickstream data and email opens/clicks.
- Communications: Phone calls, chats, emails and other communications may be recorded, transcribed and logged.
- Public-source information: Website domains, company information and publicly available social-media or website data.
- Tracking data: Cookies, HTML5/local storage, pixels, beacons, tags, scripts and log files.
Main uses
AWeber uses information to provide and support its services, process payments, send service notices and marketing, personalize the service, generate content, recommend integrations, improve services, detect fraud/spam, analyze trends, comply with law and handle business transactions.
Marketing emails may be unsubscribed from. Service, security and support communications may be mandatory.
AWeber may combine data across Customers to identify spam or misuse trends. It may also use information to automatically create content, although users may choose to use or delete that content.
2. AI/ML Training
The policy does not expressly state that customer or subscriber data is used to train artificial-intelligence or machine-learning models. It does state that AWeber may:
- Automatically create content using user information;
- Use data to personalize services;
- Analyze individual or combined data to improve services and detect fraud or misuse.
Because “improving services” and automated analysis are broad, the policy does not clearly exclude data from AI/ML development or model training. Users seeking certainty should review the Data Processing and Security Terms or obtain written clarification from AWeber.
3. User Rights and Choices
AWeber states that individuals may request information about whether it holds their personal data and may correct, update, delete or deactivate information. It generally promises a response within 30 days.
For Subscribers, the Customer is normally the data controller. Subscribers should ask the Customer to access, correct or delete their information or to stop receiving emails. If the Customer directs AWeber to remove data, AWeber says it will respond within 30 business days.
Other choices include:
- Unsubscribe from promotional emails.
- Control cookies through browser settings.
- Opt out of targeted advertising, although generic advertising may continue.
- Request removal of testimonials or public-forum information, subject to limitations.
- Use complaint procedures under the EU-U.S., UK-U.S. and Swiss-U.S. Data Privacy Frameworks.
Rights may be limited by legal obligations, dispute resolution, enforcement needs or legitimate business retention.
4. Third-Party Sharing
AWeber says it does not sell Customer, Subscriber, Advocate or Visitor information. It shares data with:
- Service providers and sub-processors needed to operate the services;
- Payment processors;
- Customer-support and live-chat providers;
- Analytics, advertising, social-media and integration partners;
- Authorities when legally required or necessary to protect rights, safety or investigate fraud;
- A buyer or successor in a merger, acquisition or asset sale.
AWeber states it does not disclose data to non-agent third parties without an opportunity to opt out, and seeks opt-in consent for materially different purposes. However, integrations and third-party websites are outside AWeber’s control and governed by their own policies.
5. Key User Obligations and Risks
Customers are responsible for the data they provide, including obtaining appropriate consent from Subscribers and using integrations responsibly. AWeber reviews mailing lists and may manually inspect data for spam or unlawful emailing.
Users should avoid posting sensitive information in public forums. Cookie rejection may limit website functionality. Information submitted to linked websites is governed by those websites’ policies.
6. Liability and Disputes
AWeber uses SSL and generally accepted security practices but expressly states that no internet or storage method is completely secure and does not guarantee absolute security.
The policy does not provide a detailed general liability cap, indemnity clause or governing-law provision. Privacy complaints should first go to AWeber. DPF complaints may be referred to TRUSTe at no cost, and qualifying unresolved complaints may proceed to binding arbitration under the DPF framework.
7. Policy Changes
AWeber may update the policy. For material changes, it says it will provide advance notice by email or website notice before the change takes effect. Users should periodically review the policy.
