LearnWorlds Privacy Policy: Key Points and Risks

1. Data Collection & Use

LearnWorlds collects different information depending on how you use its services:

Online School Administrators

If you create or operate an Online School, LearnWorlds may collect:

• Name, email address, telephone number, and business name
• Payment and subscription information
• IP address, cookies, browser and operating-system details
• Website activity, referring and exit URLs, usage data, and login frequency

This data is used to:

• Provide, maintain, secure, update, and improve the platform
• Process subscriptions and payments
• Provide customer support
• Communicate with you, including for business development and marketing
• Conduct administrative, auditing, legal, and compliance activities

LearnWorlds generally relies on contract necessity, consent, and legitimate interests as its legal bases.

End Users of an Online School

The Online School Administrator—not LearnWorlds—is generally the data controller. LearnWorlds acts as the administrator’s processor. Data may include:

• Name and email address
• Custom form fields and profile information, such as occupation, address, or job title
• IP address, cookies, browser and usage data
• Login frequency, pages visited, and activity within the Online School
• Account communications, files, and interaction data, where applicable

Practical risk: Your rights requests and privacy questions may need to be directed to the particular Online School Administrator. The administrator may collect or use data under a separate privacy policy that differs from LearnWorlds’ policy.

Site Visitors and Job Applicants

Site visitors may have technical data collected, including IP address, device information, browser version, visit time, location-related information, and website activity. Voluntarily submitted information may include an email address.

Job applicants may have their contact details, resume, education, employment history, interview information, references, and information obtained from recruitment agencies processed.

2. User Rights and Controls

Under the GDPR, users generally have rights to:

• Access and obtain a copy of their personal data
• Request correction of inaccurate data
• Request deletion, subject to legal exceptions
• Restrict or object to certain processing
• Withdraw consent where processing relies on consent
• Object to direct marketing

3. Third-Party Sharing and Transfers

Payment card data is processed and stored by payment processors rather than LearnWorlds’ own servers.

Data may be stored in Europe and the United States and transferred outside the EEA using adequacy decisions, the EU-U.S. Data Privacy Framework, or standard contractual clauses.

4. AI/ML Training

The policy states that data obtained through third-party integrations is not used to develop, improve, or train generalized AI or machine-learning models. It is used only for the requested integration functionality.

However, the policy does not clearly make the same express promise for every category of data, such as general platform usage data, support data, or data submitted directly to LearnWorlds. Users seeking a comprehensive “no training” commitment should request clarification.

For minors, LearnWorlds says it will not use or share data for advertising, behavioral targeting, or unrelated profiling, and will process it only for authorized operational or educational purposes.

5. Key User Obligations and Restrictions

Users must:

• Accept the Privacy Policy to use the site or platform
• Keep account passwords confidential and preferably change them regularly
• Review third-party privacy policies before submitting information through linked sites or integrations
• Understand that required data may be necessary to access certain features

LearnWorlds may modify the policy because of legal, business, or operational changes. It asks users to check the webpage periodically and says it will provide legally required notice of material changes.

Continued use of the site, platform, or services after an update constitutes acceptance. Users should monitor the policy and stop using the services if they do not agree with revisions.

1. Data Collection and Usage

The Terms indicate that LearnWorlds may process:

• Content uploaded or created by School Owners and End-Users, including text, images, audio, video, code, offerings, and databases.

LearnWorlds processes School Owner-controlled personal data primarily as a data processor, while the School Owner is generally the data controller. School Owners must provide appropriate notices and obtain any necessary consents before transferring data to LearnWorlds.

LearnWorlds may access accounts, Online Schools, and End-User Content for technical support, platform security, legitimate business purposes, and service operation. It may retain an archival copy of an Online School and its content for up to nine months after termination, and may retain data longer where legally required or for internal business purposes.

2. User Data Rights

The Terms state that personal data is handled under the GDPR, UK GDPR, and related data-protection laws. Depending on the circumstances, users may have rights to:

• Access their personal data.
• Correct inaccurate or outdated information.
• Request deletion or restriction of processing.
• Object to certain processing.
• Request data portability.
• Withdraw consent where processing is based on consent.
• Complain to a data-protection supervisory authority.

School Owners may delete their own or End-User Content through the authoring environment or by contacting support. Removal may not be immediate because of caching, backups, references, or circumstances outside LearnWorlds’ control.

3. Third-Party Sharing

LearnWorlds states that it does not sell, rent, or disclose End-User data to School Owners for monetary or other valuable consideration. However, data may be processed or shared:

• With service providers necessary to operate the Platform.
• With optional Third-Party Service Providers selected by the user.
• With providers of integrations, applications, experts, payment services, or other connected tools.
• With law enforcement or authorities where required or reasonably considered necessary.
• In connection with a business transfer or sale.

If users choose a Third-Party Service, that provider’s own terms, privacy policy, security practices, and data-processing arrangements apply. LearnWorlds disclaims responsibility for that provider’s access, modification, deletion, disclosure, or loss of data.

4. AI/ML Training

The Terms contain two relevant provisions:

• LearnWorlds may use uploaded Content and data in aggregated, anonymized, and de-identified form to improve the Platform, including development, diagnostics, and corrective measures.
• If users use an AI system provided through the Platform, their inputs may be used to train that AI system and may generate unauthorized, inaccurate, plagiarized, or infringing outputs.

Users are specifically warned not to submit confidential information to AI tools. LearnWorlds does not accept responsibility for AI-generated results, intellectual-property infringement, confidentiality breaches, or decisions based on those results.

5. Key User Obligations

Users must:

• Be at least 18 years old.
• Provide accurate and current account information.
• Protect account credentials and comply with applicable law.
• Own or have rights to all uploaded content and personal data.
• Obtain required privacy consents and provide lawful notices.
• Avoid unlawful, defamatory, hateful, pornographic, deceptive, harassing, privacy-invasive, or infringing content.
• Not reverse engineer, copy, resell, sublicense, circumvent security, distribute, or interfere with the Platform.
• Protect their own systems from malware and avoid unauthorized access or attacks.

School Owners are solely responsible for their Online Schools, content, legal compliance, and interactions with End-Users. They may have to indemnify LearnWorlds for breaches of their content-related warranties.

6. Liability and Disputes

The Platform is provided largely on an “as is” and “as available” basis. LearnWorlds does not guarantee uninterrupted, secure, error-free service or particular results.

For businesses, liability is broadly excluded, including for lost profits, revenue, goodwill, business opportunities, interruption, and consequential losses. Aggregate liability is generally capped at the amount paid for the relevant services during the preceding 12 months. Mandatory consumer protections and liability that cannot legally be excluded remain applicable.

Cyprus law governs the Terms. Cyprus courts have jurisdiction, although consumers retain mandatory protections available in their country of residence.

7. Changes and Termination

Terms changes generally become effective when posted online, and continued use constitutes acceptance. LearnWorlds may also notify users by email or in-app announcements, particularly for subscription-related or material changes.

LearnWorlds may modify, suspend, or discontinue features or services, sometimes without notice. It may suspend or terminate accounts for violations, nonpayment, inactivity exceeding 12 months, legal risk, or other stated reasons. After certain terminations, users generally have 30 days to download data, but LearnWorlds has no continuing obligation to retain content.
