Terms of Service Overview

*This summary covers both versions: US/non-EU and EU/UK. The Privacy Policy is incorporated into the Terms and is essential for understanding the full data practices. This is a practical summary, not legal advice.*

1. Data Collection and Usage

The Terms authorize NapoleonCat to process:

• Registration and account information, including email/login, password, and other Personal Data supplied in the registration form.
• Information about the User, Associates, and people acting for the User.
• Data from connected social-media accounts and pages, including Facebook/Messenger, YouTube, Instagram, Twitter/X, LinkedIn, Google My Business, TikTok, and potentially other platforms added later.
• Content and activity data needed to manage pages and perform analytics.
• Payment and billing information where subscriptions or automatic payments are used.
• Contact information used for commercial communications and newsletters, where the User has consented.

The company uses this information to:

• Provide, operate, and improve the Application and related Services.
• Access, manage, and analyze connected social-media accounts.
• Handle registration, billing, support, and business communications.
• Prepare and publish studies and analyses about social-media websites using data described as anonymous and aggregated, without identifying the relevant entity.

The Terms do not provide detailed retention, security, international-transfer, cookie, or profiling rules. Those matters must be checked in the Privacy Policy.

2. User Rights

The Terms themselves provide limited data-specific rights. Users may generally edit information they entered through the Account and may request password resets.

For EU/UK users, the GDPR and the separate Privacy Policy should provide rights such as access, correction, deletion, restriction, objection, portability, and withdrawal of consent, subject to legal limitations. The EU/UK Terms also include a data-processing agreement for personal data the User controls.

Important limitation: the User is treated as the controller of Associate and other third-party personal data supplied to NapoleonCat. The User must inform those individuals about the Privacy Policy and obtain or document any required permissions.

3. Third-Party Sharing and Access

NapoleonCat may access data in connected social-media accounts to provide the Services. The User represents that it has authority and any required Associate consent to connect and administer those accounts.

Data may also be handled by:

• Social-media platform operators;
• Payment institutions and billing providers;
• Hosting, infrastructure, and other service providers;
• Service providers supporting the Application.

The Terms permit publication of anonymous, aggregated analyses. They also give NapoleonCat permission to publicly identify the User as a customer, including use of the User’s business name and trademark in media, online, print, audio, and video materials. This is a notable marketing-use provision.

The Terms do not expressly describe AI vendors, model providers, or specific subprocessors.

4. AI/ML Training

The Terms do not expressly state that User content or personal data is used to train artificial-intelligence or machine-learning models.

They do permit data from connected accounts to be used for service delivery and for anonymous, aggregated studies and analyses. Whether such data is used for AI training, automated decision-making, or product-development models is not answered by these Terms. Users should consult the Privacy Policy or obtain written clarification if this is important.

5. Key User Obligations

Users must:

• Comply with these Terms, the Privacy Policy, and each connected platform’s terms.
• Have authority to administer connected pages and accounts.
• Keep login credentials confidential and promptly report compromise; monthly password changes are recommended.
• Use individual credentials for Associates and remain responsible for their actions.
• Avoid interference, unauthorized access, reverse engineering, scraping/data extraction, copying, resale, or modification of the Application.
• Avoid unlawful, defamatory, discriminatory, pornographic, threatening, privacy-invasive, or intellectual-property-infringing content.

NapoleonCat does not pre-screen or monitor posted content and may immediately suspend or terminate accounts for violations, unpaid fees, unlawful activity, security threats, false registration information, or unauthorized accounts.

6. Liability, Payments, and Disputes

Services are provided “as is,” without guarantees of availability, accuracy, security, uninterrupted operation, or error correction. NapoleonCat disclaims liability for outages, social-platform changes, lost data, business interruption, lost profits, reputational harm, and similar damages, to the maximum extent permitted by law.

Liability is capped at three times the average monthly Subscription Fee for the preceding three months. Users generally receive no refund for early cancellation, suspension, or termination caused by the User, and may remain liable for the current Commitment Period.

Subscriptions generally renew automatically. Cancellation must be made before renewal through the specified email, chat, or account method.

US/non-EU disputes are governed by South Carolina law and courts. EU/UK disputes are generally governed by Polish law and Polish courts, subject to mandatory consumer or other applicable protections. The EU/UK Terms are expressly aimed at non-consumers.

7. Changes

NapoleonCat may amend the Terms with seven days’ prior notice, generally by email and website posting. Users who object may terminate within that period; under the EU/UK version, termination generally takes effect at the end of the current Commitment Period. New registrants must accept amended Terms and do not receive a separate termination right.
