Netflix Terms of Use: Key User Implications

> Important limitation: These Terms of Use are not a complete privacy policy. They mention certain information practices but do not comprehensively explain data retention, access, deletion, sale, targeted advertising, or data-protection rights. Those issues would generally be addressed in Netflix’s separate Privacy Statement.

1. Data Collection & Usage

The Terms indicate that Netflix may collect or use:

• Account and contact information, which users must keep accurate so Netflix can send account notices.
• Payment information and payment-method details, including information updated or supplied by payment providers.
• Device identifiers and contact information, among other data, to determine eligibility for promotional offers.
• Viewing activity and account information, which may be visible to anyone you authorize to access your account.
• Interactive Feature content, such as chat messages, votes, polls, communications, and other user-submitted material. Netflix may record, monitor, analyze, modify, disable, store, and review this material using automated systems and human reviewers, particularly for safety, legal compliance, and enforcement.
• Feedback, including comments, reviews, ideas, concepts, and techniques. Netflix may use Feedback worldwide and permanently, without payment, acknowledgment, or restriction.
• Information provided during customer support, potentially through a remote-access tool. Netflix states that it may obtain full access to your computer if you consent to that tool.

Netflix may also use account, device, payment, or contact information to detect fraud, prevent identity theft, enforce the Terms, manage subscriptions, and assess promotional eligibility.

2. User Rights

These Terms do not provide specific rights to:

• Access, correct, export, or delete personal data;
• Object to processing or targeted advertising;
• Withdraw consent, except for limited situations;
• Obtain data-retention details; or
• Appeal automated decisions.

You can:

• Turn off participation in service tests through the Account page.
• Cancel your subscription at any time, generally effective at the end of the current billing period.
• Decline remote-access customer support and request assistance by other means.
• Opt out of arbitration within 30 days after first becoming subject to the Arbitration Agreement, by personally emailing the required information to Opt-Out@netflix.com. This does not opt you out of the separate class-action waiver.

Non-waivable statutory consumer or privacy rights may still apply depending on your location.

3. Third-Party Sharing

The Terms contemplate data or account relationships involving:

• Payment processors and third-party billing providers, including backup payment methods and payment information updates.
• Account holders and profile users, who may see viewing activity and alter account settings if given access.
• Extra Members, whose access and billing are controlled by the Account Owner.
• Device manufacturers and sellers, whom Netflix identifies as responsible for device compatibility.
• Advertisers, although the Terms mainly disclaim Netflix’s responsibility for advertised products and user interactions.
• Service providers or reviewers involved in monitoring Interactive Features.

The Terms do not clearly describe whether Netflix sells personal information, shares data for behavioral advertising, or transfers data internationally. Consult the separate Privacy Statement for those details.

4. AI/ML Training

The Terms do not expressly state whether Netflix uses customer data, viewing activity, communications, or Feedback to train Netflix’s own AI models.

They prohibit users from using Netflix content, service data, or associated features for machine-learning activities, including prompting, fine-tuning, training, testing, benchmarking, or validation. This restriction protects Netflix’s content and systems but does not itself answer whether Netflix trains models on user data. The permanent, worldwide Feedback license could potentially cover AI-related product development, but the Terms do not expressly say so.

5. Key User Obligations

Users must:

• Be at least 18 to create an account or become an Extra Member; minors require adult supervision.
• Use Netflix only for personal, non-commercial purposes and generally only within the same household unless using an authorized Extra Member account.
• Protect login credentials, payment details, and account access.
• Maintain accurate account and contact information.
• Pay recurring charges and cancel before renewal to avoid the next billing charge.
• Comply with geographic, device, simultaneous-streaming, and download restrictions.

Users may not copy, distribute, publicly perform, scrape, data-mine, reverse engineer, circumvent content protections, upload malicious code, or interfere with the service. Netflix may suspend or terminate accounts for violations, fraud, or suspected identity theft.

6. Liability & Disputes

Netflix provides the service “as is” and “as available,” without guarantees of uninterrupted service, error-free performance, content availability, or device compatibility. It broadly excludes liability for indirect, incidental, consequential, and similar damages, to the extent permitted by law.

Most disputes must undergo a 30-day informal resolution process and then proceed to confidential, individual JAMS arbitration, without a judge or jury. Class, collective, and representative actions are generally waived. Arbitration claims usually must begin within two years, or an applicable shorter period. Small-claims and certain government or intellectual-property claims are exceptions.

7. Changes

Netflix may change the Terms. Revisions are generally effective immediately, but material changes for existing members ordinarily take effect one month after notice. Notices and account communications may be delivered electronically only. Subscription price or plan changes must generally be notified at least one month before taking effect, allowing cancellation before the change.
