Privacy Policy Overview — Performio

1. Data Collection & Usage

Performio may collect:

• Identifiers: name, email, IP address, online/device IDs, advertising IDs, and transaction identifiers.
• Business and commercial information: job title, employer, contact details, products or services purchased or considered, and purchasing history.
• Communications: emails, feedback, complaints, reviews, and potentially audio or video recordings, including call recordings.
• Transaction data: transaction dates, payment details, card numbers, and ZIP code.
• Online activity: browsing and search history and interactions with websites, applications, advertisements, emails, and social media.
• Location information: primarily approximate location inferred from IP address.
• Third-party information: names, email addresses, profile pictures, demographic information, identifiers, and activity obtained from marketing or analytics providers.

Collection occurs through forms and surveys, direct communications, third-party tools, cookies, pixels, and similar tracking technologies. Cookies may be disabled through browser or site settings, although doing so may impair functionality.

Uses include providing and improving Services, account administration and billing, security and fraud prevention, marketing, targeted advertising, analytics, research and development, personalization, validating financial information, internal training, and legal or enforcement purposes.

Key risk: the policy permits broad use of online activity, demographic information, inferences, and communications data for marketing, personalization, analytics, and research.

2. User Rights

Rights depend on location and legal exceptions.

• EEA, UK, and Switzerland: access, portability, correction, deletion, objection, restriction of processing, and the right to complain to a regulator.
• Australia: access, correction, deletion, objection, restriction, privacy-preference management, and marketing opt-out rights.
• India: updating preferences, marketing opt-out, and correction rights are identified.
• Certain U.S. states: rights may include knowing/accessing data, deletion, correction, opting out of sale or sharing for behavioral advertising, limiting disclosure of sensitive information, and protection against discrimination.

Requests generally go to privacy@performio.co. If the request concerns information processed for a Performio customer, Performio may direct you to that customer instead.

U.S. requests require identity or authority verification. Performio generally states that it will respond within 45 days, with a possible extension up to 90 days.

3. Third-Party Sharing

Performio may share information with:

• Cloud, infrastructure, security, support, billing, analytics, marketing, and software providers;
• Business, referral, and reseller partners;
• Google Analytics, Google Tag Manager, social media, email, and advertising platforms;
• Professional advisers and affiliated companies;
• Government or legal authorities;
• Parties involved in mergers, acquisitions, or business sales; and
• Other parties with consent.

Marketing and advertising disclosures may qualify as a “sale” or “sharing” under some U.S. privacy laws. Performio states that processors are contractually restricted to instructed purposes, but it disclaims responsibility for the privacy practices of advertising partners.

Information may be transferred to and stored in the United States and other countries, potentially with less protective laws. For European transfers, Performio refers to adequacy decisions and Standard Contractual Clauses or UK transfer mechanisms.

4. AI/ML Training

The policy does not expressly state that personal information is used to train artificial-intelligence or machine-learning models. It does permit:

• Internal training using communications, including call recordings;
• Analytics, research and development, personalization, and service improvement; and
• Creation of anonymized or aggregated data for analytics and research.

Accordingly, AI training is not confirmed or clearly excluded. Users seeking certainty should ask Performio whether recordings, support communications, or other data are used in AI systems or supplied to AI vendors.

5. Key Obligations and Restrictions

• Services are not intended for anyone under 16.
• Users should avoid submitting sensitive information where possible, although the policy primarily places responsibility on Performio’s customers.
• Users must not misuse the Site or Services; Performio may investigate misconduct and enforce its rights.
• Providing certain data may be practically necessary to receive Services, even though it is usually not legally or contractually mandatory.
• Users are responsible for managing cookie, tracking, and marketing preferences.

6. Liability & Disputes

Performio promises only to take “reasonable steps” to secure information and expressly states that no website, application, Internet connection, or email transmission is completely secure. It provides no guarantee of security.

This Privacy Notice does not specify:

• A damages or liability limitation;
• Arbitration or class-action terms;
• Governing law or venue; or
• A dedicated dispute process.

Those terms may appear in separate Terms of Service or customer agreements.

7. Changes

Performio may change the Notice at any time. It will post changes online, and they become effective when posted. The policy does not promise individual emails or advance notice, so users should periodically review it.
